2.4 When using our Site(s), you must comply with the provisions of our Acceptable Use Policy set out below.

6. Service access
6.1 While we endeavour to ensure that our Site(s) is/are normally available 24 hours a day, we shall not be liable if for any reason our Site(s) is/are unavailable at any time or for any period.
6.2 Access to our Site(s) may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
7.1 If you wish to register on our Site(s) you must be aged 18 or over. We ask you to ensure that all the information provided to us is true and accurate, current and complete. If there are any changes to the details supplied to us it is your responsibility to inform us immediately.
7.2 We reserve the right to refuse to accept any application to register on our Site(s) for any reason. Registrants to our Site(s) must keep their passwords confidential.
8. Bulletin Boards
8.2 All postings received will be assumed to be for publication and any further use, at our discretion, on an exclusive, royalty free, perpetual basis.
8.3 We expect those contributing to our message boards to have information or views about the matters discussed, but our Site(s) is/are subject to the laws of libel and you could be sued if you are not careful in what you say. If contributing to a bulletin board you should not make libelous postings or any postings which are illegal or breach copyright, database or other related rights. It is your responsibility to check this out and we do not accept any liability in this respect.
8.4 If you see any information on a bulletin board which breaches your or anyone else’s rights or may be illegal, defamatory or otherwise should be removed, let us know immediately and, where we agree, we shall do our best to remove it as soon as possible.
8.5 If you breach the provisions or the Acceptable Use Policy below you must indemnify (pay) us for any losses we suffer.
8.6 Although we listen to everyone’s suggestions for new message boards, we cannot guarantee to include every topic requested.
8.7 We reserve the right to remove postings to message boards or edit them at our discretion, but have no obligation to do so.
8.8 Registered users must ensure only they use those message boards and they do not allow non-registrants to use them using a registered user’s own password.
9. Viruses, hacking and other offences
9.1 You must not misuse our Site(s) by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site(s), the server(s) on which our Site(s) is/are stored or any server, computer or database connected to our Site(s). You must not attack our Site(s) via a denial-of-service attack or a distributed denial-of service attack.
9.2 By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990 (as amended). We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site(s) will cease immediately.
9.3 We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site(s) or to your downloading of any material posted on it/them, or on any website linked to it/them
10. Acceptable Use Policy
10.1 You may use our Site(s) only for lawful purposes. You may not use our Site(s):
10.1.1 In any way that breaches any applicable local, national or international law or regulation.
10.1.2 In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
10.1.3 For the purpose of harming or attempting to harm anyone in any way.
10.1.4 To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards set out below.
10.1.5 To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam), either to us or to anyone whose details are posted on our Site(s).
10.1.6 To knowingly transmit any data, send or upload any material that contains viruses, trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programmes or similar computer code designed to adversely affect the operation of any computer software or hardware.
10.2 You also agree:
10.2.2 Not to send automated queries of any sort via our Site(s) without express permission in advance from us. Automatic queries include attempts to harvest company email or website addresses by means of spamming bots or spiders.
10.2.3 Not to access without authority, interfere with, damage or disrupt:
10.2.4.1 any part of our Site(s);
10.2.4.2 any equipment or network on which our Site(s) is/are stored;
10.2.4.3 any software used in the provision of our Site(s); or
10.2.4.4 any equipment or network or software owned or used by any third party.
10.3 We may from time to time provide interactive services on our Site(s), including, without limitation:
10.3.1 Chat rooms.
10.3.2 Bulletin boards.
10.4 Where we do provide any interactive service, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).
10.5 We will do our best to assess any possible risks for users (and in particular, for children) from third parties when they use any interactive service provided on our Site(s), and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on our Site(s), and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of our content standards, whether the service is moderated or not.

10.7 Where we do moderate an interactive service, we will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.
These content standards apply to any and all material which you contribute to our Site(s) (contributions), such as through updates to your business profile and through bulletin boards and to any interactive services associated with our Site(s).
10.8 You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any contribution as well as to its whole.
10.9 Contributions must:
10.9.1 Be accurate (where they state facts).
10.9.2 Be genuinely held (where they state opinions).
10.9.3 Comply with applicable law in the United Kingdom and in any country from which they are posted.
10.10 Contributions must not:
10.10.1 Contain any material which is defamatory of any person.
10.10.2 Contain any material which is obscene, offensive, hateful or inflammatory.
10.10.3 Promote sexually explicit material.
10.10.4 Promote violence.
10.10.5 Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
10.10.6 Infringe any copyright, database right or trade mark of any other person.
10.10.7 Be likely to deceive any person.
10.10.8 Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
10.10.9 Promote any illegal activity.
10.10.10 Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
10.10.11 Be likely to harass, upset, embarrass, alarm or annoy any other person.
10.10.12 Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
10.10.13 Give the impression that they emanate from us, if this is not the case.
10.10.14 Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
Suspension and termination
10.11 We will determine, at our discretion, whether there has been a breach of this Acceptable Use Policy through your use of our Site(s). When a breach of this policy has occurred, we may take such action as we deem appropriate.
10.12.1 Immediate, temporary or permanent withdrawal of your right to use our Site(s).
10.12.2 Immediate, temporary or permanent removal of any posting or material uploaded by you to our Site(s).
10.12.3 Issue of a warning to you.
10.12.4 Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
10.12.5 Further legal action against you.
10.12.6 Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
10.13 We exclude liability for actions taken in response to breaches of this Acceptable Use Policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

11. Barring from our Site(s)
11.1 We reserve the right to bar anyone from our Site(s), on a permanent or temporary basis at our discretion. Any such person shall be notified and must not then attempt to use our Site(s) under any other name or through any other user.
12. Legal Jurisdiction and Dispute Resolution
12.1 English law shall apply to these terms, notwithstanding the jurisdiction where you are based. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these terms and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts. The place of performance shall be England and Wales.
12.2 We make no warranty or guarantee that our Site(s) or information available on it/them complies with laws other than those of England and Wales.
